government jobs to other Federalists

• Once in power, Jefferson ordered that

James Madison (secretary of state)
not deliver the letter that informed
Marbury of his new job as a judge

• In the case Marbury v. Madison, chief

justice John Marshall ruled that it was
unconstitutional to force Madison to
deliver the papers.

• Judicial review is the right of the

Supreme Court to declare an action
of the Congress or the president
unconstitutional
