What is a torts case?

  • A tort is when one person or entity inflicts an injury upon another in which the injured party can sue for damages.

  • The injury could be anything from emotional distress to death.

  • Damages can be Compensatory (medical bills, lost wages, quantified damages), Nominal (the defendant’s conduct was wrong while concluding that no real harm was done, usually a few dollars), or punitive (meant to punish and dissuade).
