We ended last week discussing the Judiciary Act of 1801.

Today we will pick up with the Judiciary Review

Judiciary Act of 1801

• Before Jefferson took office, Federalist passed an Act that set up a system of courts.

• John Adams used this to appoint people in his last days in office.

• Congress was still under Federalist control and supported Adam’s choices which blocked  Jefferson from making any choices.

What were the midnight judges?

• This was the name given to the 16 judges that were added by the Judiciary Act of 1801.

• They were called this because Adams signed their appointments late on the last day of his administration.

• Adams did this as a way to preserve Federalist ruling in the federal government while Jefferson was in office

• Adam’s appointees  could not take effect until the “midnight judges” received the commissions

• Jefferson became president before these commissions were received. He told Madison not to deliver them
