​Reprisal by Employer Prohibited - Section 50

​Reprisal - an injury done in return for injury; attack; to revenge

​Retaliation - the action of returning a military attack; counterattack.

According to s.50, Act - the employer cannot take any form of retaliation against workers for exercising their rights.

​Example of reprisals

​Reprisal by Employer Prohibited - Section 50

If a worker believes that action has been taken against them, they can have it dealt with through arbiration if they are under a collective aggreement, or they may file a complaint with the Ontario Labour Relations Board (OLRB)

Workers can also contact the Ministry of Labour, Training and Skills Development and request an inspector visit the workplace to investigate their claim of action being taken against them for refusing work.

The onus is always upon the employer to prove that the reprisal did not occur.
