The purpose of a certification election is to determine the choice of the employees in selecting their exclusive bargaining representative or union.

Cooperative Rural Bank filed an Appeal Memorandum and sought a reversal of the Order of the Med-Arbiter. It argues that, except:

• a cooperative is not covered by the Rules governing certification elections inasmuch as it is not an institution operating for profit.

• two of the alleged rank-and-file employees seeking the certification election are managerial employees disqualified from joining concerted labor activities.

• voluntary arbitrator and the Court of Appeals found that reinstatement is no longer possible due to the fact that respondent has been continuously suffering business losses.

Issued a Resolution affirming the Order of the Med-Arbiter and dismissing the Appeal.
