 When a company has an AI feature, what’s the balance between keeping the inner workings proprietary vs. being transparent w/ the public?

• How might AI/tech fit into the 4th amendment?

  • 4th amendment: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

• An argument in Thaler v. Perlmutter: “While plaintiff attempts to transform the issue presented here, by asserting new facts that he ‘provided instructions and directed his AI to create the Work,’ that ‘the AI is entirely controlled by [him],’ and that ‘the AI only operates at [his] direction’…implying that he played a controlling role in generating the work”
