India is the second country in the world to make corporate social responsibility (CSR) mandatory, following an amendment to the Companies Act 2013, in April 2014.

The expenditure on CSR activities is non-deductible for tax purposes unless falling within provisions of Sections 30 to 36 of the Income Tax Act, 1961.

The CSR amendments does not require companies to deposit the unspent CSR funds into a fund prescribed under Schedule VII of the act.

The defaulting officer of the company may be liable to imprisonment for up to 10 years, or a fine up to INR 10 lakh or both.
