Oliver Brown and 12 other plaintiffs sued the Board of Education of Topeka, Kansas. The plaintiffs asserted that segregation is fundamentally unequal, and that the Board of Education’s segregationist policies violated the Fourteenth Amendment.

Brown Decision
Chief Justice Earl Warren delivered the opinion of the unanimous Court. The Supreme Court held that “separate but equal” facilities are inherently unequal and violate the protections of the Equal Protection Clause of the 14th Amendment. For federal contractors and subcontractors, affirmative action must be taken by covered employers to recruit and advance qualified minorities, women, persons with disabilities, and covered veterans. Employers with written affirmative action programs must implement them, keep them on file and update them annually.
