All of the programs, services, and activities that are run by state and local governments must be accessible to people with disabilities. This includes courts, schools, parks and recreational areas, and transportation.

Background:

  • Ogden had been granted a monopoly by New York State to operate a steam boat between New York & New Jersey. Gibbons was granted a similar license by the federal government. Ogden sued to stop Gibbons from competing with him. Gibbons appealed to the Supreme Court.

  • Chief Justice John Marshall ruled that Congress (the federal gov't) could regulate ferry boats trading between two or more states as part of its power under the Constitution to control "interstate commerce" (trade between states).

Background:

  • In 1818, the Maryland legislature put a tax on the Maryland branch of the Second National Bank. Maryland legislators hoped that state taxes on the federal bank would shut it down.

  • James McCulloch, the federal banks cashier, did not pay the taxes that Maryland law required and Maryland sued for payment.

  • Maryland will win its case in their own courts but the case will be appealed to the Supreme Court.

  • The case presented two key issues:

  • Does Congress have the power to create a National Bank even though that power is not specifically mentioned in the Constitution?

  • Does Maryland have the power to tax an institution of the federal government?

Decision/ Significance:

  • Marshall ruled that Congress could indeed charter (create) a national bank, since this would help Congress carry out its other powers. Marshall said that the "necessary & proper" clause (elastic clause) in the Constitution gives Congress all those powers needed to carry out its powers listed in the Constitution.

  • He also said since the federal government had the right to establish the bank, Maryland had no right to interfere by taxing it.
