What items are found in the Americans with Disabilities Act?
All of the programs, services, and activities that are run by state and local governments must be accessible to people with disabilities. This includes courts, schools, parks and recreational areas, and transportation.
Makes sure we are not discriminated against when we are working or applying for a job. It does not guarantee that we will get the job, but makes sure we have a fair chance. If we are qualified for the job, we have the right to be interviewed. If we are hired, we have the right to be paid the same salary as everyone else. Employers must also make some accommodations, or changes to the job that will help us be successful.
People with disabilities must be able to communicate. For example, people with hearing impairments or those who are deaf may not be able to use the regular phone lines. Communication devices that allow people to type in their words instead of listening or speaking must be available. Sign language interpreters should be provided when needed.
Public places must be accessible if they were built or renovated after the ADA was passed in 1990. This includes any place members of the general public go, such as restaurants, movie theaters, malls, and grocery stores.

Ogden had been granted a monopoly by New York State to operate a steam boat between New York & New Jersey. Gibbons was granted a similar license by the federal government. Ogden sued to stop Gibbons from competing with him. Gibbons appealed to the Supreme Court.

Chief Justice John Marshall ruled that Congress (the federal gov't) could regulate ferry boats trading between two or more states as part of its power under the Constitution to control "interstate commerce" (trade between states).
It set the stage for future expansion of Congressional power over other activities once thought to be under the control of the states.

Background:
In 1818, the Maryland legislature put a tax on the Maryland branch of the Second National Bank. Maryland legislators hoped that state taxes on the federal bank would shut it down.
James McCulloch, the federal banks cashier, did not pay the taxes that Maryland law required and Maryland sued for payment.
Maryland will win its case in their own courts but the case will be appealed to the Supreme Court.

Issues brought to the Supreme Court
The case presented two key issues:
Does Congress have the power to create a National Bank even though that power is not specifically mentioned in the Constitution?
Does Maryland have the power to tax an institution of the federal government?

Decision/ Significance:
Marshall ruled that Congress could indeed charter (create) a national bank, since this would help Congress carry out its other powers. Marshall said that the "necessary & proper" clause (elastic clause) in the Constitution gives Congress all those powers needed to carry out its powers listed in the Constitution.
He also said since the federal government had the right to establish the bank, Maryland had no right to interfere by taxing it.
