Chapter 3 Review

Define Liability.

• The state of being legally responsible for the harm one causes another person

Define Negligence.

• Failure to use moderate or mediocre care

Define Torts

• Legal laws committed by a person

Define Omission

• When an individual fails to perform a legal duty

Define Commission

• When an individual fails to perform a legal duty

Define Statute of Limitations 

• A specific day to sue for damages from negligence
• A specific length of time to sue for damages from negligence
• A specific month to sue for damages from negligence
• A specific year to sue for damages from negligence

Define Assumption of Risk

• The individual. through agreement, assumes that some risk or danger will be involved

Define Nonfeasance

• Commits act not legally theirs to perform
• Failure to perform legal duty
• Improperly does something they have legal rights to do

Define Malfeasance

• Commits act not legally theirs to perform
• Failure to perform legal duty
• Improperly does something they have legal right to do
