Judiciary Act:

  • Before Jefferson took office, Federalist passed an Act that set up a system of courts.

  • John Adams used this to appoint people in his last days in office.

  • Congress was still under Federalist control and supported Adam’s choices which blocked  Jefferson from making any choices.

  • Those who Adam’s appointmented could not take effect until the “midnight judges” received the commissions

  • Jefferson became president before these commissions were received.
