The Cherokee tribe was a Native American tribe that lived in what is now Georgia for hundreds of years. As more and more white Americans began to move into Georgia, it was discovered that valuable resources such as gold were on Cherokee lands. These new settlers desired the land of the Cherokee because of the wealth that was there. In order to get the land, white settlers used a law called the INDIAN REMOVAL ACT to get the state of Georgia to remove the Cherokee from their lands.

The Cherokee did not give up easily. They sued the state of Georgia for trying to remove them from their land and their case went all the way to the Supreme Court. This court case became known as WORCESTER V GEORGIA. The Supreme Court decided in FAVOR of the Cherokee. They declared that the state of Georgia had no right to kick the Cherokee of their lands since they had lived there for hundreds of years and declared the Indian Removal Act UNCONSTITUTIONAL. The Supreme Court made their decision and they expected Andrew Jackson as president to respect their decision...

The Constitution says that the President's job is to enforce the decision of the Supreme Court once it is made. But Jackson simply IGNORES the courts decisions. He allows the state of Georgia to continue to remove the Cherokee from their lands in order to clear the way for white settlers. He also sends the U.S. Army to Georgia in order to forcibly remove the Cherokee from their homes
To the Cherokee, Andrew Jackson is a villain and acts like a KING. He should have obeyed the decision of the Supreme Court but decided to ignore the decision and help white settlers take the land of the Cherokee.

Big IDea 2: Andrew Jackson's Response

In 1836, the Cherokee were given two years to migrate voluntarily. If at the end of those 2 years the Cherokee had not moved out they would be forcibly removed from their homes. The Cherokee were then forced to march over 2000 miles to the west to lands set up by the U.S. government for Indians only (modern day state of Oklahoma). In this march over 4000 Cherokees died of cold, hunger and disease. Because they were forced out of their homes and because so many died on the way to the new "Indian Territory" this march became known as the TRAIL OF TEARS.
