All families incur certain child-rearing costs and includes an average amount to cover these for various levels of the parents' combined income and number of children, comprised of housing, food, transportation, basic public educational expenses, clothing, and entertainment.

Assumptions

The standard method for setting child support obligations is based on the income of the parent(s) and other factors determined by state law.

Credit for other children

Sets forth two classes of children for whom credit may be given:

  1. Children under a previous support order (out-of-home children)

  2. Legal children in parent's home (in-home children)

Parenting Time Adjustment

  • Base support amount will change if over 121 overnights

  • Adjustment given for overnights.

    • presumptive rather than mandatory

  • CP may have child support obligation if he/she has the child less than 60% of the time

  • Provides remedy for CP if NCP fails to exercise ordered overnights​

43 O.S. § 118F

43 O.S. § 118F- Reasonable

"Reasonable in cost" means that the pro rata share of the actual premium cost for the child or children paid by the insured does not exceed five percent (5%) of the gross income of the responsible parent. To calculate the actual premium cost of the health insurance, the court shall:

  1. deduct from the total insurance premium the cost of coverage for the parent and any other adults in the household

  2. ​divide the remainder by the number of dependent children being covered, and

  3. ​multiply the amount per child by the number of children in the child support case under consideration.
