• it is a juridical necessity to give, to do, or not to do (Art. 1156)

• Also defined as a juridical relation whereby a person called the creditor may demand from another, the debtor, the observance of determinate conduct, and in case of breach, may obtain satisfaction from the assets of the latter

• Have no right or accept such payment but obligation to return because of mistake

• Criminal liability will give rise to civil liability only if the same felonious act or omission results in damage or injury to another and is the direct and proximate cause thereof, intent or motive

if that obligation is not part of the sources of obligation, that means it's not valid.
