Trade Union

A trade union is, EXCEPT

• any association or combination of employers in West Malaysia, Sabah or Sarawak

• either temporary or permanent

• within any trade, industry or department

• any association or combination of employees who work either in West Malaysia, Sabah or Sarawak

The objectives of a trade union are, EXCEPT

• to promote the interests of the members

• to obtain and maintain justice for the members. (proper rates of remuneration, security of employment etc)

• to promote the social welfare of the members

• to obstruct the legislation affecting the interests of the members

Trade union is categorised into

• public sector employer union

• private sector employees union

• white-collar union

• blue-collar union

Composition of a union is based on, EXCEPT

• either the group of employees or group of employers

• either the employees /employers in Sabah, Sarawak or West Malaysia

• either in private or public sector

• within same industry or ministry

Listed are the criteria of the registration of a trade union, EXCEPT

• it needs to be registered within a month from its establishment

• the registration period may be extended to up to 6 months time

• it is not necessary to register a trade union

• it needs to be applied from the Minister of Human Resource

The consequences of an unregistered or a de registered trade union are as follows, EXCEPT

• it shall be an unlawful association and shall cease to enjoy any rights, privileges and immunities.

• it shall not take part in any trade disputes or promote, organize or finance any strike or lockout or provide benefits for its members during a strike or lockout.

• it shall not be dissolved and its funds retained.

• only those assigned for the purpose of dissolving the union and disposing the funds can take part in its management or organization.

• Make application to the DGTU

• Signed at least by six members of the union
